Who should take the fall for the illegal activities at the Board of Regents?

With Robert Kennedy’s resignation, will Governor Malloy and the Legislature decide that the Regent-gate crisis is resolved or will they push to ensure that additional people are held accountable for the illegal and inappropriate activities that took place?

Nearly $300,000 in pay raises were “authorized” by Kennedy without the approval of the full Board of Regents, as required under the law.

The Key Issues are;

  • Everyone involved was certainly aware of the Malloy-SEBAC state employee agreement which prohibited pay raises for the two years of the biannual budget.
  • The Board of Regents’ compensation process is governed by Section 10a-1b of the Connecticut State Statues.  It is a new law that was proposed by Governor Malloy, adopted by the General Assembly and signed into law by the Governor.
  • The law is hardly ambiguous.  Sec. 10a-1b (b) reads; “The president may employ staff as is deemed necessary, including, but not limited to, temporary assistants and consultants. The board shall establish terms and conditions of employment of its staff, prescribe their duties and fix the compensation of its professional and technical personnel.”
  • In addition, on Wednesday, November 2, 2011, the CONNECTICUT BOARD OF REGENTS FOR HIGHER EDUCATION held a five hour retreat at the Connecticut Science Center as part of the board training process.  The first item of the morning was, “Discussion – Roles and Responsibilities of the Board of Regents.”  Later they discussed the “Fiduciary responsibilities,” the “Decision-making processes within the Board” and “The Board and President’s leadership roles.”

Meanwhile the Board of Regents top executive staff are hardly neophytes.

In addition to Robert Kennedy, there is;

Michael Meotti who serves as the Executive Vice President.  He has served as a Commissioner of Higher Education, a CEO of a major non-profit “think-tank” and a State Senator.  His raise was $47,800 on top of his initial base salary of $184,424

Elsa Núñez who serves as the Vice President for State Universities.  She serves as President of Eastern Connecticut University and has held numerous top level administrative jobs in higher education.  Her raise was $48,000 on top of her salary of $299,460

David Levinson who serves as Vice President for Community Colleges.  He serves as President of Housatonic Community College and has held other high ranking positions in higher education.  His raise was $48,000 on top of his salary of $204,188

And Colleen Flanagan, who served as Governor Malloy’s press secretary for over a year, Director of Communications for the Board of Regents and now serves as the Chief of Staff for the Board of Regents.  Her raise was $24,000 on top of her salary of $130,000

Furthermore, the Regent’s Director of Human Relations is one of the two most experienced human relations administrators in Connecticut State Government.

And finally, while the Board of Regents is relatively new, it is made up of members who have significant public and private sector experience.  It is inconceivable that some of these board members were not aware that some inappropriate activities were taking place.

The Board of Regent members include;

Lewis J. Robinson, Jr. – Chair Lewis J. Robinson, Jr. is a seasoned attorney with a comprehensive background in business, law and government affairs, as well as charitable organizations.

Yvette Meléndez - Vice Chair – Yvette Meléndez, Vice President of Government and Community Alliances for Hartford Healthcare, has three decades of public policy experience.

Richard J. Balducci – Richard J. Balducci of Deep River is vice president of Doyle, D’Amore and Balducci in Hartford and former Speaker of the House.

Naomi K. Cohen – Naomi K. Cohen has served in numerous educational leadership positions, including House Chair of the General Assembly’s Education Committee.

Lawrence DeNardis – Dr. Lawrence DeNardis is President Emeritus of the University of New Haven and a former United States Congressman from Connecticut.

Nicholas M. Donofrio – Nicholas M. Donofrio led IBM’s technology and innovation strategies from 1997 until his retirement in October 2008.

Matt Fleury – Matt Fleury became President and Chief Executive Officer of the Connecticut Science Center April 1, 2009, after serving as the Center’s Executive Vice President and COO.

Michael Fraser – Michael Fraser is an undergraduate Political Science student with a minor in History at Western Connecticut State University.

Merle W. Harris – Merle W. Harris has 45 years of educational experience, serving in several positions at institutions of higher education, in Connecticut.

Gary F. Holloway – Gary F. Holloway is a founder of Five Mile Capital Partners LLC, an alternative investment and asset management company. Halloway is, “Managing Member, Principal, and Chairman at Five Mile Capital Partners. He is also the Founder of the firm. Prior to Five Mile, Mr. Holloway spent 15 years at Greenwich Capital Markets/Greenwich NatWest Securities, retiring in 2001 as Chairman of Greenwich Capital. During this period, Greenwich Capital grew from a virtual start-up to one of the premier investment banks in the fields of fixed income securities and structured products.”

Craig Lappen – Craig Lappen is President of 21st Century Financial Advisors in Manchester. He graduated from Ohio Wesleyan University and has an MBA in finance from the University of Connecticut.

René Lerer – René Lerer is Chairman and Chief Executive Officer of Magellan Health Services, with more than 30 years of experience in the healthcare field. René Lerer, M.D., is, “ chairman and chief executive officer of Magellan Health Services, one of the country’s leading specialty health care management organizations, leveraging clinical excellence, innovation and operational expertise to manage behavioral health, radiology, specialty pharmaceuticals and Medicaid benefits. The company’s customers include health plans, employers and government agencies, serving approximately 33.7 million members in its behavioral health business, 17.1 million in its radiology benefits management segment, and 7 million members in its medical pharmacy management product. In addition, the specialty pharmaceutical segment serves 40 health plans and several pharmaceutical manufacturers and state Medicaid programs. The Company’s Medicaid Administration segment serves 24 states and the District of Columbia.”

Michael E. Pollard – Michael Pollard is co-founder of Optul Global Services, LLC. Also consult for Integrated Technical Systems, Inc.

Alex Tettey Jr. – Alex Tettey Jr. is an undergraduate student pursuing a Liberal Arts and Science degree at Manchester Community College.

Zac Zeitlin – Zac Zeitlin (Westport) is a former partner of Silver Point Capital, where he ran the firm’s Principal Finance business.  Zeitlin was a senior partner at Silver Point Capital L.P, “Silver Point Capital is a privately owned hedge fund sponsor. The firm manages hedge funds for its clients. It invests in the public equity, fixed income, and hedging markets of the United States. The firm primarily invests in securities of distressed, large-cap, and Mid-cap companies; bank debts; bonds; and trade claims. It specializes in credit analysis and diversified credit-related investments.”

In addition there are four Ex-Officio members;

Jewel Mullen – In December 2010, Governor Malloy announced his appointment of Dr. Jewel Mullen as Commissioner of the Connecticut Department of Public Health (DPH).

Sharon Palmer – Who has just been appointed Commissioner of the Connecticut Department of Labor

Stefan Pryor – Stefan Pryor was selected by Governor Malloy and the State Board of Education to serve as Education Commissioner in 2011.

Catherine Smith -Catherine Smith is the Commissioner of the Connecticut Department of Economic and Community Development (DECD).

    She is basically a kid. Obvioulsy she has been popular with Chris-almost-a-Felon Dodd and Dan Malloy.
    Did she have to stand in line for this job or was she plucked out of the conga line at the Hibernian Hall? Maybe her young lobbyist husband asked around Hartford about job openings…BUT GETTING HIRED AND GETTING THAT KIND OF RAISE when Big Dan Malloy officiated at her wedding?! DAN IS NECK DEEP IN THIS NONSENSE. UP TO HIS EARS and he should be held accountable! No telling what other kind of shenanigans could be revealed by a closer look at this crew! The “retirement” Gary Holloway is a good example. He was let go,basically pushed to the curb, and in fifteen years might have done well but GreenwichCapital goes way back and without CRT they would have been nothing…and all that goes way beyond fifteen years. BOSH! Typical WallStreet lies and spin!
    The whole list could probably be revealed for what it is…a bunch of free-loaders sucking on the public teat,all orchestrated/manipulated by Big Dan Malloy.

      Flanagan is a pure patronage job for the former Attack Husky and Queen of Snark.
      CT loves its Ent Moots. Its Big Butt Committees. Its overpaid appointees. It’s the problem with job growth. Flanagan’s job could be don for 1/2 the money leaving $75,000 for two more employees — a mid-level and a clerical. Adamowski should be forcibly retired and stay that way in this economy. His job could create 4 mid-level jobs..
      Along with pension reform for the state we need retirement ages enforced to open up more posiitons for the young.. End the double dipping and rehires.

    BREAKING NEWS!!! Dan Malloy to appoint Whitey Bulger to the Board of Regents. Whitey will be working “remotely” while his relocation to Connecticut is arranged. Dan Malloy announced that he was “thrilled” that Whitey would come on board and welcomed the discipline that he was known for in his past appointments.

      My elation over Kennedy and Meotti has turned into ashes at the news of the greedy reformy clone of Adamowski, Kishimoto.
      Maybe the outrage over these inflated salaries will extend to the Hartford School District, and we will see the end of Kishimoto and the whole Broad-infected cabinet of talent officers, PR people, etc. Get rid of Adamowski, et al.
      The “consultants” beloved of Pryor and paid for by SERC or whatever shell company or front operation they are using–out, out, damn spots!

    Fire Adamowski and Pryor. If there are laws regarding raises, why aren’t there any regarding invented, nonsensical positions like Special Master? Why should a totally unqualified hack like Pryor get a commissioner’s job, and then spend his days hiring high-paid consultants and filling poslitions with Broad Residents? WTF? Where can we find out what these consultants make?
    And what exactly is the story on the CTScience Center? Why is Adamowski in love with this place? He tosses all kinds of business their way, I see from Jonathan’s post that the Board of Regents held a retreat there (??), and now Windham has hired one of their museum directors (Harick is her name I think) as Head of the New Windham STEM Magnet school–the one Adamowski baptized as a STEM with no imput from anyone in Windham, and which will require pricey Professional Development provided by the–you guessed it!–CT Science Center.
    While I am happy to see the back of R. Kennedy–Elsa Nunez’s former boss at the Univ. of Maine–I would like to see some outrage over the ed. reform patronage of Malloy and Co.
    Adamowski’s next bit of “no-bid” gifting is to CREC, whose director is going to tell Windham all about how necessary a Montessori for the select few of tony Windham Center is–with classes capped at 17–a Montessori reg, they tell the Board of Ed.–while at the rest of the schools classes balloon in size, and Natchaug gets bigger and more dangerous, but, hey, Windham needs the “swing space” and apparently the State will pay for a roof for “swing space.”

      I’m as disgusted by the apparent cronyism going on re Flanagan as anyone. But am I the only one feeling a bit uncomfortable about the tone of these comments? “That bitch is a Husky.” “She needs to get knee-capped.” Am I missing something here? Maybe there’s some inside info that I’m not privy to? Are you suggesting that Malloy and Flanagan are/were involved in a sexual relationship? Your comments feel misogynistic and unnecessarily violent.

        I agree that the comments are getting over the top. It’s one thing to point out the cronyism and conflicts of interest, but personal attacks, cursing, and misogyny are completely unnecessary and damage the actual message.
        Jonathan has deleted some comments on the grounds of propriety, but I don’t think we want to see constant monitoring. I guess it’s up to him, but maybe a call to civility is best. “Buygold” usually has interesting contributions, but even I though he/she was a little too invested in the Flanagan issue.

    But why is it that Public School Reformers, like Adamowski, can come in swinging, and fire whomever they want? No more guidance counselors in Hartford Schools–BAM!–no more history classes–BAM!–no more physics in High School–BAM! BAM! And then the whole model is expanded thanks to Coleman, Pryor, Malloy, the Bridgeport takeover artists, with a lot of help from Race To The Top and various foundations. What, is it okay to fire principals and teachers who have served for years? I’m glad that the CC presidents weren’t swallowing this, but I am horrified that most of Connecticut doesn’t give a rat’s a** about public schools (and they are all public schools, “failing” or not).
    We really need to strike while this issue is hot.

    Why is the Education Committee of the CT general assembly not concerned with the equally troubling activities of the state’s public school administrators? Maybe we should be demanding that the bonuses of Kishimoto in Hartford, the sinecures of Adamowski, and the empire of Vallas should be treated with the same scrutiny as the Higher Ed. commission has directed toward Kennedy et al–where officials and the public have cried foul on hefty raises and threats to existing employees.     Stop beating up on public schools! The activities of Adamowski in terms of making special deals with parents and creating inequities throughout districts by “creaming” students and keeping class size down in some locales, not to mention his hiring of architectural firms who then get choice jobs without bidding–why is no one criticizing this? Susan Johnson, you are on the Ed committee! You must condone this. You probably applauded Elsa Nunez’s $48,000 raise (Meotti wasn’t the only one getting such a boost).

    I only twisted the nicknames a bit. Misogynistic? Hardly. I hate everyone equally but I could accuse the folks here and elsewhere for letting all this happen in the first place. Do you really think “The Husky” would go easy on people or interests that she deemed as her opposition? Did you listen to Dan Malloy on the campaign trail? His henchmen,like Roy Occhiogrosso? Sullivan & LeShame? (sorry,intentional and perhaps offensive to some)
    I appreciate Jon letting me spew vitrol. I will back off but rest assured that “civility” is what got all of us into this mess and others. Whispering instead of shouting. Nutmeggers might even want to get beaten up by their government…seems that way to me. When you do not hold politicians and public servants accountable for their behaviour they tend to do just what has occured with the BOR and state government in general. I may have seem obsessed with the $150K a year apparatchik but the stupidity of the whole mess got the better of me yesterday.
    From top to bottom,govenment in this state absolutely stinks. The only difference between Ct and RhodeIsland politics is geography.
    If you were offended,you should be. Again,I appreciate Jon keeping my posts up and will go easier for the sensitive readers. I will say that other blogs began to edit my comments as well and rightly so because the powers that be tend to have attornies who can muck up our freedoms. Several blogs are more worried about making money than free discourse. I know…if I have so much to say start my own blog. Obviously I have the time but lack the resources and skills.

      I don’t have a problem with cursing. And I certainly agree with you that “civility is what got all of us into this mess and others.” My opinion–Americans, in general, prefer to allow blatant corruption over dealing with the “discomfort” of confrontation. And I agree with “From top to bottom, government in this state absolutely stinks.” Though I’d take it a step further and suggest that it’s certainly not limited to this state. Just thought the “doggy style” and “bitch” comments were a little over the top–with misogynistic overtones. Sounds like I misinterpreted, though. No problem–I just feel that when posters start to go “over the top” a forum runs the danger of being taken less seriously. I have been called out a couple of times myself. Initially, I was annoyed. But overall, I understand the need to keep comments in check to a certain degree. You certainly don’t need to censor your comments on my account. As long as you don’t mind if I speak up if I find something offensive. :)

        I just was/am absolutely appalled that the web of corruption is so deep and extreme in this state. Cathy Malloy and her salary? Colleen Flannagan and her salary.Off-topic but interesting salary:
        “A spokesperson,Gian-Carl Casa ($127,759 a year) for Dan’s budget office announced that the administration has not made “any precise estimates yet” regarding the drastic (and worsening) lack of gaming revenue.”
        I was young,but I cheered when the bank burned in Isla Vista. Today…most people would be put out because they are inconvenienced. And the “leaders” know this and are taking advantage of our collective weakness.
        Compare Dan’s statement welcoming Austin to his statement welcoming Kennedy.
        The more things change,the more they stay the same or get worse. And another thought before I attend to Saturday business… would this whole BOR mess have been revealed if the CC Presidents had not had their jobs threatened? Was the CtMirror story planted to protect more misdeeds and is the BOR just a tip of the iceberg…sort of like John-the-Felons mustang.

    I’m going to back back and clip out a few of the comments in the last couple of days. As we like to say here at Wait, What?, it’s my blog so I’m the only one who can call people “inappropriate.” These rest of you can only call people “appropriate” names. That is neither to confirm nor deny that some of the things that have been said, don’t deserve to be said… and we do have to weigh the old adage if the shoe fits…

    But since I’ve maintained my stance that we want a “welcoming” environment here in comment land, I’m going to remind everyone – be civil – at least when possible.

    That said, I always applaud when someone figures how how to weave the word Misogynistic into their statements… …
